Terms of Service

By accessing or using Digital Timecapsule (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and Digital Timecapsule LLC ("we", "us", "our", "Company").

Digital Timecapsule is a private legacy preservation platform operated by Digital Timecapsule LLC, a limited liability company organized under the laws of the State of Wyoming, United States. The Service enables users to record, organize, and pass on personal memories, family history, life goals, estate planning documents, and time-locked messages to designated beneficiaries.

Eligibility. You must be at least sixteen (16) years of age to create an account. By registering you represent and warrant that you meet this age requirement and that all registration information is accurate, current, and complete.

Account security. You are responsible for safeguarding your login credentials and for any and all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain the confidentiality of your credentials.

Account activity. You are solely responsible for the content posted, uploaded, or transmitted from your account and for any consequences resulting from that activity.

You retain full ownership of all content that you create, upload, or store on the Service ("User Content"). We do not claim ownership of your User Content.

By uploading User Content you grant Digital Timecapsule LLC a limited, worldwide, royalty-free, non-exclusive license solely to store, back up, encrypt, transmit, and deliver your User Content to you and to the beneficiaries and recipients you designate through the Service. This license exists only to operate the features you request and terminates when you delete the content or close your account, subject to reasonable backup retention periods.

You agree not to use the Service to:

• engage in any illegal activity or violate any applicable law or regulation;
• impersonate any person or entity or misrepresent your affiliation with any person or entity;
• harass, threaten, defame, or otherwise infringe the rights of any other person;
• upload content that infringes the copyright, trademark, or other intellectual property rights of any third party;
• upload or transmit viruses, malware, or any other malicious code;
• attempt to gain unauthorized access to the Service, other user accounts, or our systems;
• use the Service to send unsolicited communications ("spam");
• reverse engineer, decompile, or disassemble any portion of the Service.

We do not sell your data to third parties. Ever. Our full data handling practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

All sales are final once an access code has been issued and redeemed. Monthly subscription cancellations revoke access for the remaining months of the plan. No refunds will be issued on redeemed access codes. Family member invites are non-refundable once accepted by the recipient. Additional family accounts are $19 per person, one-time.

The $29 Founding Member price (or the equivalent $2.99/month for ten months, totaling $29.90) is available only to the first five hundred (500) members. Once 500 Founding Member spots have been claimed, the standard price applies to all new members. Existing Founding Members are never affected by future price changes; their plan, price, and access are locked at the terms in effect when they subscribed.

Digital Timecapsule, the PECR (Physical, Emotional, Creative, Relational) goal system, Timecapsule Shop (TC Shop), Legacy Transfer, and all other platform features, designs, trademarks, logos, and content (excluding User Content) are the intellectual property of Digital Timecapsule LLC. All rights reserved. No license to use any of our intellectual property is granted except as expressly set out in these Terms.

The DTC AI Assistant is powered by third-party artificial intelligence technology. Responses generated by the AI Assistant are for informational and navigational purposes only and do not constitute legal, financial, medical, or any other professional advice. You should not rely on AI Assistant responses as a substitute for professional consultation.

Any estate planning templates, checklists, or guidance provided through the Service are for informational purposes only and do not constitute legal advice. Estate planning laws vary by jurisdiction. You should consult a licensed attorney in your jurisdiction before executing any estate planning document.

Digital Timecapsule LLC is not a licensed fiduciary, trustee, estate executor, or probate court. The Legacy Transfer feature is a digital organizational and delivery tool only, provided to help you communicate wishes to designated recipients. It does not replace a legally executed will, trust, or other estate instrument.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL TIMECAPSULE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, ANY FAILURE OR DELAY IN LEGACY DELIVERY, OR THE LOSS, CORRUPTION, OR INADVERTENT DISCLOSURE OF USER CONTENT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless Digital Timecapsule LLC, its founder, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of or access to the Service, (b) your violation of any term of these Terms, (c) your violation of any third-party right, or (d) any User Content you upload or transmit.

To report alleged copyright infringement, please email dtcapsule@gmail.com with the subject line "DMCA Notice". Your notice must include: (i) a physical or electronic signature of the copyright owner or authorized agent; (ii) identification of the copyrighted work claimed to be infringed; (iii) identification of the material claimed to be infringing and its location on the Service; (iv) your contact information; (v) a statement of good faith belief that use is not authorized; and (vi) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner.

Digital Timecapsule LLC reserves the right to suspend or terminate any account that violates these Terms, engages in unlawful conduct, or otherwise puts the Service or its users at risk. Where practicable we will provide notice and an opportunity to export your User Content prior to termination.

These Terms and any dispute arising out of or related to them or the Service are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-laws principles. You consent to the exclusive jurisdiction of the state and federal courts located in Wyoming for any such dispute.

We may update these Terms from time to time. Material changes will be announced in the Service or via email. Your continued use of the Service after any such change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
